By accessing or using Bake Nomads ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

These terms apply to all users of the Platform, including customers, vendors, and visitors.

Bake Nomads is an online marketplace that connects local bakers and food vendors with customers. We provide:

• A platform for vendors to list and sell their products
• Order management and payment processing services
• Communication tools between vendors and customers
• Custom design features for personalized orders

We act as an intermediary and do not produce, manufacture, or deliver the products ourselves.

Registration To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Take responsibility for all activities under your account

Account Types

• Customer Accounts: For purchasing products from vendors
• Vendor Accounts: For selling products on the Platform (subject to approval)

We reserve the right to suspend or terminate accounts that violate these terms.

Vendors on Bake Nomads agree to:

Products and Services

• Accurately represent products with descriptions and images
• Maintain proper food handling and safety standards
• Comply with all applicable health and food safety regulations
• Fulfill orders in a timely manner

Pricing and Fees

• Set fair and competitive prices for products
• Pay a 10% platform commission on all sales
• Accept the payment terms and payout schedules

Prohibited Conduct

• No false or misleading product information
• No sale of prohibited or illegal items
• No circumvention of platform fees or policies

Customers on Bake Nomads agree to:

Ordering

• Provide accurate delivery and contact information
• Review orders carefully before confirming
• Communicate any special requirements or allergies

Payment

• Pay for orders in a timely manner
• Use valid payment methods
• Report any payment issues immediately

Conduct

• Treat vendors with respect
• Provide honest reviews and feedback
• Not engage in fraudulent or abusive behavior

Order Process

1. Customers place orders through the Platform
2. Vendors receive and confirm orders
3. Vendors prepare and deliver/provide pickup for orders
4. Customers receive products and can provide feedback

Payment Processing

• All payments are processed securely through Stripe
• The 10% platform fee is deducted from each transaction
• Vendors receive payouts according to Stripe's schedule

Refunds and Cancellations

• Refund policies are set by individual vendors
• Cancellations may be subject to fees
• Disputes should be resolved directly with vendors first

Platform Content All content on Bake Nomads, including logos, designs, and software, is owned by Bake Nomads or its licensors and is protected by intellectual property laws.

User Content

• Vendors retain ownership of their product images and descriptions
• By posting content, you grant us a license to use, display, and distribute it on the Platform
• You represent that you have the right to share any content you post

Trademarks "Bake Nomads" and our logos are trademarks. You may not use them without permission.

Disclaimer THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

• Uninterrupted or error-free service
• The quality or safety of products sold by vendors
• The accuracy of vendor information

Liability Cap To the maximum extent permitted by law, Bake Nomads shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits or data
• Damages exceeding the amount paid to us in the past 12 months

Vendor Responsibility Vendors are solely responsible for their products, including food safety and quality.

You agree to indemnify and hold harmless Bake Nomads, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Platform
• Your violation of these terms
• Your violation of any third-party rights
• Products you sell (for vendors)

Between Users Disputes between customers and vendors should be resolved directly. We may mediate but are not obligated to do so.

With Bake Nomads

• We encourage informal resolution first
• Any legal disputes will be resolved through binding arbitration
• Class action waivers apply
• The arbitration will be conducted in San Francisco, California

We reserve the right to modify these terms at any time. Changes will be effective upon posting to the Platform. Continued use of the Platform after changes constitutes acceptance of the new terms.

For significant changes, we will provide notice through email or platform notifications.

By You You may terminate your account at any time by contacting us or using the account settings.

By Us We may suspend or terminate your account for:

• Violation of these terms
• Fraudulent or illegal activity
• Extended inactivity
• Any reason at our discretion

Upon termination, your right to use the Platform ceases immediately.

These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any legal action must be brought in the courts of San Francisco County, California.
